This was all legal under civil forfeiture, the quirk of the American criminal justice system under which a person’s property can be seized even if they are not convicted, or even accused, of a crime.
I experience this as painfully saddening, in that this is even a question, let alone a lawsuit that requires a court deciding to uphold the extension of basic human decency, to children 😪 Even more troubling is that I'm not surprised the current US administration would take this to court, as well as how desensitized most of the population has become to the atrocities of family separation.
This is a very compelling argument for open borders. Many concerns and fears around immigration could be alleviated with some additional policy - for example limiting welfare benefits and voting rights to newest immigrants.
